Christopher O’Connell, Esq.

My practice is focused on the representation of Condominiums, Homeowner Associations, and Cooperatives and my main duties are to assist Property Managers and Board of Directors in their day-to-day operation of the Association.  This requires me to have substantial knowledge of the corresponding statutes and case law.

I have drafted full sets of Amended and Restated Governing Documents for clients, along with single Amendments to the Governing Documents.  I have dealt with Marketable Record Title Act issues for Homeowner Associations.  I have drafted Opinion Letters on all sorts of different topics, including but not limited to, Association versus Unit Owner maintenance issues, insurance, material alterations, Association access to Units, reasonable accommodation requests, special and regular assessment passage and collection, and application of Master Association covenants on Sub-Associations.

I have written numerous Covenant Enforcement Letters to Owners.  The topics include rentals, pets, material alterations, and maintenance.

I have litigated hundreds of cases on behalf of Associations.  The majority of cases pertain to Assessment Collection and Foreclosure.  I have represented Associations as both Plaintiff and Defense counsel in Foreclosure actions.  I have litigated many other issues as well, including eviction, maintenance responsibility, and disputes related to the amounts of delinquent assessments owed to the Association from a Bank which has foreclosed.
